Comment
The High Court considered a father’s application for contact with his four children and disclosure of their whereabouts. At the time of his application the father was a serving prisoner (twenty-eight months imprisonment) following his conviction for a violent assault on the mother. The father had previously received a police caution for assault and child cruelty.
The mother opposed any contact between the children and their father a position supported by the children’s guardian. The mother had also cross-applied for permission to change the children’s surname.
The court ordered that there be no direct or indirect contact between the father and the children save for permitting the father to provide twice yearly letters via CAFCASS. The court also granted permission for the surnames to be changed considering the children’s safety to be sufficient justification for this change.
